Jimoh Ibrahim Sued Over Dubious Aircraft Deals in US

Jimoh Ibrahim Sued Over Dubious Aircraft Deals In US, Creditors Demand Over $7.68 Million

Jimoh Ibrahim
Nigerian businessman Jimoh Ibrahim, chairman of the Energy Group, of which the now defunct Air Nigeria Development Ltd. is part, has been dragged to the US District Court in New York by creditors who are claiming over $7,685,837.55 plus interest, costs, and attorneys' fees.
United States-based aircraft leasing company and its affiliates, Aersale Inc., Aersale 27910 LLC and Aersale 27469 LLC are responsible for the joint lawsuit.
Legal documents seen by SaharaReporters suggest that Ibrahim, who is the sole or majority owner of Air Nigeria, entered into an agreement with the Aersale Group as the Guarantor to lease two Boeing 737-300 airplanes for his airline.
The plaintiffs allege that in order to induce lessors into the agreement, Mr. Ibrahim issued a guarantee to execute prompt payment and also to ensure the swift conduct of Air Nigeria's obligations under the lease agreements. They charge, however, that Ibrahim’s Air Nigeria breached the lease agreements by failing to, among other things, make the basic and additional payments to the Aersale Group and also failing to return the aircraft in the condition required under the Lease Agreements.
According to the plaintiffs, a clause in the Lease Agreement required Air Nigeria to make monthly payments of $125,000 for the first thirty-six (36) months of the lease term and $120,000 for each subsequent month.
The Basic Rent Payments were supposed to be paid on the first (1st) day of each month throughout the lease term while Supplemental Equipment Rent payments were to be paid on or before the tenth (10th) day of each consecutive month during the term. The agreement stipulates that default would occur when Air Nigeria failed to make basic or supplemental equipment rent payments within three (3) days of the due date; when Air Nigeria becomes unable or admits its inability to pay by the due date; or when Air Nigeria fails to comply with any of the stipulated clauses in the agreement.
Once an Event of Default is established, the agreement gives Aersale the right to declare the Lease Agreement null and void and to cancel it, proceed to court to recover lost revenue, demand that Air Nigeria returns the aircraft in the manner and condition required by the specified redelivery conditions, and lease the repossessed Aircraft to any third party; among other things without recourse to Air Nigeria.
Under the terms of the agreement, upon a declaration of default, Air Nigeria is also obliged to pay all arrears of rent as well as the other amounts pertaining to Supplemental Equipment Rent. In addition, Ibrahim, on behalf of Air Nigeria is also liable as the Guarantor to pay for costs incurred by Aersale in the process of repossessing and refurbishing the aircrafts, recovering rent or other amounts due under the Leases etc.
In spite of the guaranty however, from December 2011, Air Nigeria has been late in its payment of a series of Basic Rent and Supplemental Equipment Rent. As a result, Aersale cancelled the Lease Agreements on March 27, 2012. At the time of the termination, Air Nigeria was in arrears of $1,271,447.31, a figure that is likely to increase with each passing day.
Upon receipt of the Termination Notice, Air Nigeria pleaded with Aersale to suspend the termination and resolve the issues out of court. In response, on March 30, 2012, Aersale agreed to temporarily suspend termination of the Lease Agreements provided that Air Nigeria remitted full payment of all outstanding balances under both Lease Agreements together with its Basic Rent payment for April 2012.
On April 3, 2012, Air Nigeria paid $1,000,000 of its outstanding obligations under the Lease Agreements, promising to make good the remaining balance by the end of April, 2012. However they failed to honor that promise.
When approached on the subject, Air Nigeria's Chief Executive Officer, Kinfe Kahssaye declared "Unfortunately, we were not able to do it due to few aircraft in operation." Despite persistent demands by Aersale since then, Ibrahim and his Air Nigeria have failed to discharge the outstanding obligations under the Lease Agreements.
On May 25, 2012 Aersale sent a letter to Air Nigeria, copied to Ibrahim, reminding them of the breach of contract and demanding that Air Nigeria immediately cease operating the aircraft and redeliver them in accordance with the terms of the lease agreements. Then on May 29, 2012, another letter was sent notifying them of the rental arrears in the amount of $1,185,572.62 and demanding prompt payment. Several other letters were sent after that but up till today, Air Nigeria and Ibrahim the Guarantor have failed to comply.
Aersale has thus filed a lawsuit against Ibrahim, the Guarantor, in a New York court claiming an amount not less than $7,685,837.55 plus interest, costs, and attorneys' fees.
It will be recalled that Jimoh Ibrahim has been the subject of a number of lawsuits and investigations over issues including falsely issuing a guarantee for his own company, diverting funds secured with one of his companies illegally into another and dishonestly acquiring shares in other companies.
Notably, he is alleged to have fraudulently hijacked 51% shares of the popular Newswatch magazine only to run it down. The Economic and Financial Crimes Commission (EFCC) of Nigeria has also questioned him over the establishment of Energy Bank in Ghana and Sao Tome and a shady purchase of a private jet in 2009 which he allegedly laundered monies from a pension fund to acquire.

Mr. Ibrahim is also alleged to have channeled over N35 million of aviation funds – a loan granted to Air Nigeria as part of the government’s efforts to rescue the ailing domestic aviation industry— into the account of NICON Investment Limited, a company owned 100% by he and his wife.
The enigmatic Lagos businessman has also been sued by the Federal Inland Revenue Service (FIRS) of Nigeria for 5 years of tax evasion and forgery of Tax Clearance Certificates against Air Nigeria.  Aggrieved former staff of Air Nigeria who he fired en masse has also sued him.

Baba Suwe Loses N25million law suit

Baba Suwe Loses N25 Million Award At The Court of Appeal

Baba Suwe in court
A panel of Court of Appeal judges in Lagos today set aside the N25 million compensatory damages earlier awarded Lagos comedian, Babatunde Omidina " Baba Suwe " over a prolonged detention by the National Drug Law Enforcement Agency (NDLEA) last year.
In the ruling, the Court of Appeal re-affirmed the right of the NDLEA to investigate, arrest, detain and prosecute drug suspects as long as the agency acts within the law.
The court said the NDLEA had not violated Mr. Omidina's rights because it sought and got court orders from the federal high court to keep him in custody after the arrested him on the suspicion that he had ingested hard drugs.
The Court of Appeal came down heavily on the Lagos High court judge that awarded the damages against the NDLEA, describing the decision as oppressive and burdensome to an agency of government carrying out its statutory duties.
Baba Suwe's attorneys led by civil rights activist, Bamidele Aturu,  has vowed to take the matter before the Supreme Court

Supreme Court Dismisses Former Ekiti Governor's Appeal

Kayode Fayemi
By SaharaReporters, New York
The Supreme Court today finally settled the electoral feud between a former governor of Ekiti State, Olusegun Oni and the incumbent, Kayode Fayemi by affirming Mr. Fayemi as the rightful winner of the 2007 governorship election in the state.
A five-man panel of the court led by Justice Sylvester Ngwuta stated in their decision that Mr. Oni's appeal who sought to exploit the judicial crisis at the Court of Appeal, lacked merit and thus dismissed his appeal. Mr. Oni had complained to the court that new evidence available to him showed that he was denied a fair hearing according to section 36 of the Nigerian constitution because the court of Appeal that threw him out of office was biased. He then prayed the court to revisit the judgement.
However, the Supreme Court judges unanimously decided that Mr. Oni's appeal was an attempt to sneak back into the Ekiti State government house    through the back door as he knew that the Court of Appeal was the court of last resort with  jurisdiction to try the matter conclusively.
The court dismissed Oni's appeal but awarded no costs.

Abdul-Baki Todashev, Father of Boston Bomber, Claims his Son was Executed by FBI

Abdul-Baki Todashev, Father Of Ibragim Todashev, Claims His Son Was Executed By FBI

MAKHACHKALA, Russia — The remaining suspect in the Boston Marathon bombings has recovered enough to walk and assured his parents in a phone conversation that he and his slain brother were innocent, their mother told The Associated Press on Thursday.
Meanwhile, the father of a Chechen immigrant killed in Florida while being interrogated by the FBI about his ties to the slain brother maintained that the U.S. agents killed his son "execution-style."
Dzhokhar Tsarnaev, 19, walked without a wheelchair to speak to his mother last week for the first and only phone conversation they have had since he has been in custody, Zubeidat Tsarnaeva told the AP.
In a rare glimpse at Dzhokhar Tsarnaev's state of mind, he told her he was getting better and that he had a very good doctor, but was struggling to understand what happened, she said.
"He didn't hold back his emotions either, as if he were screaming to the whole world: What is this? What's happening?," she said.
The April 15 bombings killed three people and wounded more than 260. Elder brother, 26-year-old Tamerlan Tsarnaev, was killed in a shootout with police, and Dzhokhar remains in a prison hospital after being badly wounded.
"I could just feel that he was being driven crazy by the unfairness that happened to us, that they killed our innocent Tamerlan," their mother said, standing by the family's insistence that their children are innocent.
The Tsarnaevs met the AP in their new apartment in a 14-story building in a well-to-do area of Makhachkala, the capital of the restive Caucasus province of Dagestan. The apartment had no furniture apart from a TV, a few rugs, and wallpaper materials lying on the floor.
Anzor Tsarnaev, the suspects' father, said they bought it for Tamerlan, his wife, and their young daughter in the expectation that they would move to Makhachkala later this year. He added that they planned to turn their old home in a dingy district on the outskirts of town into a dentist's office, so that Dzhokhar, a dental hygiene student, could work out of it after completing his studies.
"All I can do is pray to God and hope that one day fairness will win out, our children will be cleared, and we will at least get Dzhokhar back, crippled, but at least alive," Tsarnaev said.
Separately, at a news conference in Moscow, the father of a 27-year-old mixed martial arts fighter who was killed during FBI questioning accused agents of being "bandits" who executed his son.
Abdul-Baki Todashev showed journalists 16 photographs that he said were of his son, Ibragim, in a Florida morgue. He said his son had six gunshot wounds to his torso and one to the back of his head and the pictures were taken by his son's friend, Khusen Taramov.
It was not immediately possible to authenticate the photographs.
The FBI says Todashev was being questioned by an FBI agent and two Massachusetts state troopers about his ties to Tamerlan Tsarnaev, as well as about a 2011 triple slaying in Massachusetts.
Three law enforcement officials said initially that Ibragim Todashev had lunged at the FBI agent with a knife, although two of them later said it was no longer clear what had happened.
The father said his son was "100 percent unarmed."
Taramov confirmed Thursday that he had taken some pictures of Ibragim Todashev's body at an Orlando funeral home and sent them to the father. He said Ibragim Todashev had a decorative sword with a broken handle, but that it was not a weapon.
"The sword wouldn't cut nothing," Tamarov said. "I played with it many times. It wasn't sharp from any angle. It would do the same harm as a piece of wood."
The father said Taramov told him that U.S. agents interrogated him on the street while five officials interrogated Todashev in his Florida house for eight hours on May 22, the night he was shot.
Todashev's father said that his son moved to the U.S. in 2008 on a study exchange program and met Tsarnaev at a boxing gym in Boston in 2011, about a year before he moved to Orlando. He said the two were "not particularly close friends."
Prior to last month's bombings, Todashev underwent an operation for a sports injury and was on crutches, making it physically impossible for him to have been involved in the bombings, his father said. He added that Todashev had recently received a green card and was planning to return to Chechnya for the summer last Friday, two days after he was killed.
The father said he and his brother were interviewed at the U.S. Embassy in Moscow on Thursday as they sought a visa to take his son's body back to Chechnya.
FBI agents interrogated the younger Todashev twice before the night he was shot, his father said. He said his son told him that he thought Tsarnaev had been set up to take the blame for the bombings.
"I'd only seen and heard things like that in the movies – they shoot somebody and then a shot in the head to make sure," Todashev said.
"These just aren't FBI agents, they're bandits," he added.
The FBI wouldn't comment on the claims made by Todashev's father.
The Tsarnaevs' parents have held fast to their belief that their sons were framed. Zubeidat Tsarnaeva, dressed all in black and still visibly distressed, showed AP several YouTube videos on an iPad she claimed cleared her sons. They could not be authenticated by the AP.
"I remember when our cat was sick, Tamerlan was sick himself for two days afterward, because he was so worried about her," Tsarnaeva said.
She said Tamerlan told her about Todashev, and that she and her husband had invited him to visit them in Russia, though he never came. Tamerlan later told them that he and Todashev were unlikely to continue training together since they practiced different sports, and he appeared to have lost track of him after Todashev moved to Florida, Tsarnaeva added

Sylva Loses Bid to Reclaim Passport

EFCC Press Release: Sylva Loses Bid To Reclaim Passport

Former Bayelsa State Governor, Timipre Sylva today failed in the bid to repossess his international passport as Justice Adamu Bello of the Federal High Court, Abuja threw out his application for lack of merit.
Sylva had approached the court for the release of his passport claiming that he needed the document to enable him travel to the United Kingdom to be with his wife who is due to undergo a surgical procedure.
At the last sitting, his counsel told the court that the former governor had given an undertaking that as soon as he returns from overseas, he will deliver the passport back to the Registrar of the court.
The defence counsel further told the court that the accused person surrendered himself voluntarily to the court in June 2012 when the he was arraigned. He reminded the court that the passport was released to the accused last year to enable him travel and that upon his return, he promptly brought the said document to the court.
Prosecution counsel, John Ainetor however opposed the application. He asked the court to dismiss the application in the interest of justice. He said the accused did not need any medical attention personally, but only wanted to accompany his wife who he claims needed medical attention.
The EFCC counsel also revealed that there were pending allegations against the accused person and his wife and that the trip was a ploy to escape current investigation and possible trial.
Justice Bello in his ruling on Thursday May 30, 2013 dismissed the application on the grounds that the London doctors will deal directly with accused wife and so the application lacks any urgency. The judge also held that the letter from the London Hospital was addressed to No. 38 Malbrone Avenue, London where the wife of the accused is residing and so had no link with the former governor.

Four Arab Men Questioned Over Arms Find In Kano

Arms recovered by Nigerian Troops in Kano
It was learnt that Nigerian military authorities were questioning four foreign nationals suspected to be from a Middle Eastern country over a large consignment of arms and ammunitions intercepted in a warehouse located in the Bompai area of Kano, the Kano State capital.
A security source also told us that the owner of the warehouse, simply identified as a Lebanese national, was also a guest of Nigerian military interrogators over the shock discovery.
As at the time of this report, the building on Gaya Road, Bompai, where the weaponry was found was under heavy military guard.
A spokesman for the anti-terrorist Joint Task Force and member of the 3rd Brigade of the Nigerian Army, Captain Ikedichi Iweha, indicated that the brigade would brief reporters on the issue later today. He declined to make further comments on the incident, which occurred on Tuesday night.
“You will get the details tomorrow (Thursday),” he said. He added, “Because of the Democracy Day celebrations we have decided to talk to you after the break.”
A security source told our correspondent that security was beefed up in the commercial city of Kano as a result of the Democracy Day celebrations. There was a significant increase in vehicular patrols by officers of the JTF and the police. “You can see that our patrols made it possible to achieve the kind of peace that the people of Kano have not experienced in recent months,” a security official said.
Some of Kano’s terror flashpoints attracted the largest presence of soldiers and police. The areas include Kurna Asabe, where two persons were reportedly killed last Friday by unknown gunmen, Hotoro-Mariri, Yankaba and Badawa. The areas are suspected hideouts for gunmen.
In a fresh video message released yesterday by Boko Haram, the militant group’s leader, Abubakar Shekau, threatened more violence targeted at members of the press, the police and the military. In the one-hour video, the sect’s leader also threatened the country’s politicians and members  of their families, accusing them of corruption. Mr. Shekau also denied reports that many of his men had been killed in the recent onslaught carried out by soldiers in the North East States where emergency rule had been declared by President Goodluck Jonathan.
“There is no truth in that claim, it is only a propaganda, in all we have only lost seven members while the Soldiers cannot count the number of their men who were killed in the confrontation” .
He warned that those who have made it their stock in trade to expose the Boko Haram members and their activities to security agents should wait and see what would happen to them.
He accused the Media of dishing out falsehood against the sect especially on casualty figure its members.
In the video also displayed military patrol vehicle purportedly seized by the militants and some captured and dead soldiers.

Nigerian Army Links Boko Haram To Hezbollah

Nigerian troops in the Joint   Task Forces in Kano today said that investigations into the discovery of weapon cache found in a home occupied by Lebanese foreign nationals in Kano shows that Boko Haram Islamist militants have connections with the Lebanon-based Hezbollah

After painstaking search of the whole premises, the search team uncovered an under ground bunker in the the master bed room where a large quantity of assorted weapons of different types and caliber were recovered.
The bunker was specially constructed for this purpose. It is worth mentioning to say that the weapons include anti tank weapons, rocket propelled guns, anti tank/anti personnel mines among other dangerous weapons.
All the weapons and ammunition recovered were properly concealed with several layers of concrete and placed in coolers, drums and bags neatly wrapped.
These discoveries were not accidental but the out come of an ongoing robust counter terrorism investigation by the Department of the State Services Abuja in the past several months. The investigation also confirms the existence of a Hizbullah Foreign Terrorist Cell in Nigeria. Consequently, the DSS on 16 May 2013 arrested one Mustapha Fawaz the co-owner of the popular Amigo Supermarket as well as the wonderland Amusement Park all in Abuja. Thus, his arrest and confession unveiled other members of the foreign terrorists network which led to the interception of one member of the syndicate named Abdullah Tahini a Lebanese national at the Mallam Aminu Kano International Airport  with undeclared amount of sixty thousand United States Dollars on him enroute Beirut. There after on 26 May 2013 one Talal Roda also a Lebanese with Nigerian Passport was arrested in this same house.

Families Of 40 Police Officers Killed In Kano Yet To Be Compensated

Photo: Daily Independent Nigeria
Members of the Presidential Committee on Dialogue and Peaceful Resolution of Security Challenges in the North heard today in Kano that compensation has yet to be paid to the families of the 40 officers killed in a Boko Haram attack on January 20, 2012.
A total of 192 persons, including security personnel from the Department of State Security Services (DSS), Immigration and Customs, were killed.
Members of the committee, who were conducted around the State Police Headquarters, were also told that the Command’s Bomb Disposal Unit has intercepted over 6000 Improvised Explosive Devices (IEDs), most of which were detonated. They inspected assorted explosives seized from suspected militants of the Islamic sect.
Speaking during the occasion, the chairman of the committee, Alhaji Kabiru Tanimu Turaki, dispelled the notion of a contradiction between the work of his committee and emergency rule in Yobe, Borno and Adamawa States.
“Nigeria is not at war,” he declared, adding that even in countries where there is war, dialogue is also applied.
“No responsible government will sit down and allow a group of individuals to threaten lives and properties. The issue is that those who want to take the option of dialogue will have it; and those who want to continue to fight will continue to fight.”
The Committee also met with members of the bereaved families of the slain police officers, and the Alhaji Turaki promised that efforts would be geared towards their immediate compensation.

Woolwich Attack: Lee Rigby Named As Victim-BBC

Woolwich Attack: Lee Rigby Named As Victim-BBC

Drummer Rigby
The soldier killed in an attack on a London street has been named as Drummer Lee Rigby of the 2nd Battalion the Royal Regiment of Fusiliers.
Drummer Rigby, 25, from Manchester, leaves behind a two-year-old son.
Two men are under arrest in hospital after police shot them near Woolwich Barracks on Wednesday afternoon, in the aftermath of the attack.
The suspects, believed to include Michael Adebolajo, were known to security services, sources have said.
The victim's name was announced by the Ministry of Defence pending formal police identification.
"An extremely popular and witty soldier, Drummer Rigby was a larger than life personality within the Corps of Drums and was well known, liked and respected across the Second Fusiliers," the MoD statement said.
Commanding officer Lt Col Jim Taylor said of Drummer Rigby: "An experienced and talented side drummer and machine gunner, he was a true warrior and served with distinction in Afghanistan, Germany and Cyprus."
Capt. Alan Williamson said: "Drummer Rigby or 'Riggers' as he was known within the platoon was a cheeky and humorous man, always there with a joke to brighten the mood."
Speaking outside 10 Downing Street on Thursday, Prime Minister David Cameron said the attacks were "solely and purely" the responsibility of the individuals involved.
Defence Secretary Philip Hammond said: "We are not going to be cowed by this kind of terrorist action."
"Everyone in defence is shocked and saddened by the events of yesterday," Mr Hammond said more than 24 hours after the killing.
"This was a senseless murder of a soldier who has served the Army faithfully in a variety of roles including operational tours in Afghanistan. Our thoughts today are with his family and loved ones who are trying to come to terms with this terrible loss."
Mr Hammond was asked if the attack showed how vulnerable soldiers were, whether they were in uniform or not.
He replied: "I think it reminds us how vulnerable we all are, but it also reminds us, by the response of the public, that we are not going to be cowed by this kind of terrorist action."
Shortly after the killing a man, thought to be 28-year-old Mr Adebolajo, was filmed by a passer-by, saying he carried out the attack because British soldiers killed Muslims every day.
Sources said reports the men had featured in "several investigations" in recent years - but were not deemed to be planning an attack - "were not inaccurate".
They confirmed one of the suspects was intercepted by police last year while leaving the country.
According to BBC sources, Mr Adebolajo, a Briton of Nigerian descent, comes from a devout Christian family but took up Islam after leaving college in 2001.
The Metropolitan Police said police officers arrived within nine minutes of the first 999 call and armed officers were there within 14 minutes
An increased police presence will be in Woolwich and the surrounding areas through Thursday night and "as long as needed", Assistant Commissioner for Specialist Crime and Operations Mark Rowley said Properties in Greenwich and Saxilby, Lincolnshire, have been searched in connection with the attack
With dozens of witnesses to the killing, police are urging them to contact the Met's anti-terrorism hotline with information Chief of Defence Staff General Sir David Richards said: "It's always a tragedy, it's particularly poignant that it happened on the streets of this capital city of ours.
"We're absolutely determined not to be intimated into not doing the right thing - whether it's here in this country or in Afghanistan or wherever we seek to serve the nation."
Security at Woolwich Barracks and others in London has been increased, and Gen Richards said: "I'm confident that base security is as tight as it's every been, and necessarily so.
"It's a very difficult balancing act. We are very proud of the uniform we wear, we have huge support around the country, this is a completely isolated incident."

Mr. Cameron highlighted the actions of cub scout leader Ingrid Loyau-Kennett, who spoke to one man holding a knife, saying it demonstrated that "confronting extremism is a job for us all".
"When told by the attacker he wanted to start a war in London, she replied, 'You're going to lose. It is only you versus many.' She spoke for us all," Mr Cameron said.
BBC defence correspondent Caroline Wyatt said that since British forces intervened in Iraq and Afghanistan, they and their families have been well aware they might be targets at home.
At least two plots by Islamist extremists to kill soldiers in the UK have been foiled in recent years.

President Goodluck Jonathan has condemned the terrorist attack and killing of a British soldier, Fusiliers in the Woolwich area of London, United Kingdom; and strongly condemns this unfortunate incident.
Drummer Lee Rigby of the 2nd Battalion of the Royal Regiment was savagely attacked and killed on an open street yesterday.
Sending his condolences to British Prime Minister David Cameron and the British people, Mr. Jonathan described the incident as a “senseless and barbaric act.”
He said that a terrorist attack anywhere is an attack on the way of life of all free nations and must be collectively condemned by all persons irrespective of race, ethnicity or religion.
“It is in this spirit that the Nigerian government is partnering with the British Government, as well as all other stakeholder sovereigns to stand up to and fight terrorism and extremism in whatever guise or pretense it chooses to present itself,” he said in a statement signed by a spokesman.
“President Jonathan recognizes that each environment presents its own unique challenges and peculiarities and [that while] actions taken by affected nations may differ, yet the resolve to confront and defeat this threat should never be in doubt.”
Taking the opportunity to comment on the challenge of Boko Haram, President Jonathan said that Nigerians are collectively resolute about the need to protect the freedoms that define our existence and inter-relationships at home and overseas.
“Our recent past tells us that when we pull together, this common enemy and threat will eventually be defeated,” the statement concluded.

Grounded Rivers Aircraft: Reps Clear Amaechi And Indict NCAA, NAMA…Say Aircraft Belongs to Rivers State

Grounded Rivers Aircraft: Reps Clear Amaechi And Indict NCAA, NAMA…Say Aircraft Belongs to Rivers State

A committee of the House of Representatives has determined that Rivers State Governor, Chibuike Rotimi Amaechi, did not break any laws in the incidents that led to the grounding of a state-owned Bombardier Aircraft by the Nigerian Civil Aviation Authority (NCAA).
The legislators stated that Rivers State remained the real owner of the B700 Global Express Aircraft with Registration Number N565RS with a valid insurance cover that will expire in 2015.

The representatives also found there was no truth to the claim by Nigeria’s aviation agencies that the aircraft belongs to a foreign country and has no valid papers.

These were some of the conclusions contained in a report by the House committee on Justice and Aviation. The committee investigated the circumstances that led to the controversial grounding of the aircraft.

The 11-page report was jointly signed by the House Committee Chairman on Justice, Ali Ahmad, and his Aviation counterpart, Nkeiruka Onyejeocha. The House had composed the committee on April 30, 2013 to probe the grounding of the aircraft by the NCAA.

The committee sat on May 14, 2013 and took testimonies from officials of the NCAA, the Nigeria Aviation Management Authority (NAMA), Aviation Minister, Stella Oduah, as well as officials of Caverton Helicopters and the Rivers State Government.

The report stated, “The level of ineptitude of NCAA is glaring in many respects: failure to appreciate from a trust agreement that an aircraft belongs to a trustor-beneficiary even after their attention is drawn to it and even as other aircraft are registered in the name of the same trustee; non-detection of an expired flight clearance 24 days after the fact and the detection was triggered by an incident rather than as a matter of course; even if the fact of falsification of documents were true.”
The report added: “It was unacceptable that NCAA did not detect this fact for over six months; indeed NCAA boasted in a letter of 29th April, 2013 that following the incident it undertook a due diligence of the status of the aircraft, but even then it failed to determine the issue of ownership and several others.

“Operational and other navigational charges were received by NAMA and FAAN and other agencies while operating the aircraft and receipts issued without raising  alarm as to ownership of the aircraft by Rivers State Government.
Part of the report also stated: “Perusal of the Trust Agreement between Rivers State Trustor and Bank of Utah Trustee would have shown this fact of ownership; it is distressing that NCAA and the Ministry still fail or refuse to appreciate this simple fact; but since the authorities did not raise ownership issue with several other aircraft having the name of Bank of Utah Trustees, this allegation is in bad faith and grossly unprofessional, as the owner, Rivers State Government elected to register the aircraft in the U.S. to save money for the State and avoid unnecessary bureaucracy.
“Rivers State Government, through Caverton, applied to the Hon. Minister of Aviation to import and operate the aircraft in Nigeria but the application was not consummated, and so it is being operated in Nigeria as a foreign aircraft for private use.

“As from 27 August, 2012 when it applied on behalf of Rivers State Government to import the aircraft, Caverton maintained agency relationship with the Government; although that relationship was abated shortly thereafter with regard to importation of the aircraft, other aspects of the agency relationship continued especially relating to applications for flight clearance; however, all relationships between the parties was brought to an end by Caverton’s letter of denunciated to NCAA dated 26 April, 2013.

“As owner and operator of the aircraft, neither Rivers State Government nor its officials forged or falsified any document toward securing flight clearances or any other license. Should top management of Caverton deny transacting business with Rivers State Government despite its acquiescence of transactions between its member of staff and the Government, then its behavior smacks of administrative laxity or negligence; alternatively, its behavior lends credence to the assertion that it was pressured to deny the relationship.
 “Caverton should be held accountable for providing information that led NCAA to ground the aircraft, contrary to provision of the law;
“Rivers State Government operated its aircraft with expired clearance between 2nd and 26th April, 2013; but several other aircraft are suspected to be in similar situation; isolation of Rivers State Government for reprimand becomes difficult to deny.

“Justifications for both the delayed start-up in Akure and the continued grounding of the aircraft in Port Harcourt amount to taking an action and later shopping for reasons: the faulty declaration of manifest and failure to file flight plan ceased to be a reason immediately the  Director-General of NAMA waived the infringement and permitted the aircraft to depart Akure, otherwise continuous citing manifest and flight plan violations as additional reasons for grounding the aircraft has serious implications for the Director-General; alleged fabrication of documents by Rivers State Government was unsubstantiated.
“Having overlooked the Akure violation, the only justification known to law to warrant regulatory action against the aircraft is its operation with expired clearance between 2nd and 26th April, 2013; however, NCAA botched the opportunity to legally impose the sanction as it failed to give a written notice to Rivers State Government as required by Section 35(5) Civil Aviation Act, Cap. C13 Laws of the Federation of Nigeria, 2004;
“The handling by NAMA and NCAA of this violation and their response actions further confirm the previous findings of the Joint Senate and House Committee on Aviation on the crash of Dana Aircraft that the Ministry of Aviation exerts undue interference on routine operations of these agencies.”

The report suggested that the House Committee on Aviation be mandated to scrutinize the reason for rampant foreign registration of aircraft by their owners and to further investigate all private-use aircraft operating in the country in order to sanitize their operation and ensure enforcement of the law.

Westboro Baptist Church Member Blames Oklahoma Tornado On Jason Collins' Coming Out

A prominent member of the Westboro Baptist Church is drawing a link between theOklahoma tornado's devastation and a local team's support for openly gay NBA starJason Collins.
Fred Phelps Jr., the son of Westboro Baptist Church minister Fred Phelps, said in his twitter account.

It isn't the first time that an anti-gay pundit has attempted to blame a natural disaster to the lesbian, gay, bisexual and transgender (LGBT) community. In 2012, chaplain John McTernan linked Hurricane Sandy (and a number of other recent weather-related trends and natural disasters) on LGBT people and President Barack Obama's backing of marriage equality.
"God is systematically destroying America," McTernan wrote at the time. "Just look at what has happened this year."
McTernan similarly linked Hurricane Isaac with the LGBT community, pointing to the fact that the life-threatening storm coincided with Southern Decadence, New Orleans' "Gay Mardi Gras."
"New Orleans is still hosting Southern Decadence with open homosexuality manifesting in the streets of the city," he wrote in a blog. "It could be that God is putting an end to this city and its wickedness."

Two robbers had an interesting reaction after being found guilty of theft: They started making out in the courtroom.
The arresting courtroom scene occurred in Mossel Bay, South Africa, last Wednesday at the trial of a male-female team accused of robbery.
Eyewitnesses say the court session was well underway when the couple decided to engage in a different kind of courting and starting pawing each other and grinding their hips as the judge and jury watched,IOL.co.za reported.
The orderlies eventually pulled the couple apart and the judge instructed the kinky couple to sit on opposite sides in the dock for the rest of the proceedings, according to Witness.co.za.
After kinky couple was found guilty of robbery, the judge slapped them with contempt of court and public indecency.
The unidentified couple has yet to be sentenced, but they aren't the only people who've tried to avoid renting a room by getting crazy in a courthouse.
Last month, Roderick Clanton, 23, faced charges for having consensual sex with a 15-year-old girl inside a New Orleans courthouse, according to WWLT-TV.
Clanton is being held on a $10,000 bond and several outstanding warrants. The 15-year-old girl was taken into custody as a juvenile and later released to her family.

Nephew's Genitals Found In South African Man's Wallet, Murder Charges Pending

Genitals In Wallet

A man in South Africa was reportedly found with his nephew's genitals in his wallet, in a bizarre case that will likely lead to murder charges for the man.
BBC reports that the unidentified man was arrested Wednesday and taken by police to a forest in Eastern Cape, where he led them to his 18-year-old nephew's mutilated corpse.
That's when they discovered his nephew's genitals in his wallet.
"We found that the hands, the head and legs were cut off from the body and we then recovered the private parts in his wallet," Mzukisi Fatyela, police spokesman for the Eastern Cape Province, told AFP.
The victim went missing from the town of Ngcobo on Sunday.
Police aren't releasing more details, but are investigating whether the murder -- and the genital possession -- might be a "muti" killing, when witchdoctors use body parts in their potions, according to the BBC. There is reportedly a market for the illicit sale of human body parts for such purposes in South Africa.
Charges are expected for the uncle.

Syria rebels call for reinforcements as war spreads abroad

Rebels fighting for control of the Syrian town of Qusair called for reinforcements on Wednesday to repel forces loyal to President Bashar al-Assad in a civil war which is spreading violence through an already volatile region.
Opposition fighters said air strikes and shelling rocked the small town on the Syrian-Lebanese border that has seen some of the fiercest fighting in months in the two-year-old war that has so far cost at least 80,000 lives.
The fighting has drawn in fighters from Lebanon's Hezbollahmovement, the latest sign of outside involvement in the war and evidence, according to Britain, that Iran and its allies in the militant group are lending increasing support to Assad.
After months of warnings from regional and international experts, violence is now spilling over Syria's borders, with clashes between pro- and anti-Assad factions in the Lebanese city of Tripoli and exchanges of fire between Syrian and Israeli forces in the Golan Heights.
Alarmed by the prospect of a wider conflict, the United States and Russia have agreed to back international peace talks intended to bring the rebels and Syrian government back to the table, although expectations of a breakthrough are low.
Security fears following bombings that killed 51 people in the Turkish town of Reyhanli earlier this month prompted Turkey on Wednesday to close a nearby border crossing with Syria. Turkey has accused Syria of involvement in the attacks. Damascus has denied any role.
While rebels are reinforced by foreign Islamists loyal to al Qaeda, the high-profile involvement of Iranian-backed Hezbollah on the government side has been accompanied by a report from a senior U.S. official of the presence of Iranians in Qusair.
SENATE BOOST
In a boost to the rebels, a U.S. Senate panel voted overwhelmingly on Tuesday to send them weapons, but it was not clear who would get the arms even if the bill succeeds.
The Senate Foreign Relations Committee voted 15-3 for legislation that would send arms to "vetted" moderate members of the Syrian opposition, the first time U.S. lawmakers have approved such military action in Syria.
The measure will now be considered by the full Senate, where a vocal group of legislators has been pushing for President Barack Obama to do more to help the rebels.
There is less enthusiasm for arming the rebels in the Republican-controlled House of Representatives, so it is not clear whether a Senate bill would ever get through Congress and reach Obama and be signed into law.
The outcome in Qusair will determine the status of important rebel supply routes into Syria and whether Assad can ensure access to important northern areas. It could also mean devastation for areas of nearby Lebanon.
Sunni rebel leaders have warned of sectarian revenge attacks against Shi'ites and Alawites on either side of the Syrian-Lebanese border if rebels lose Qusair. Fighters speak of a tacit agreement among their units to launch village by village attacks should they lose the town of 30,000.
George Sabra, acting head of the opposition National Coalition, called on fighters to send arms and men to the Qusair area, citing concern over sectarian violence and "foreign invaders" from Hezbollah and Iran.
WEAPONS APPEAL
"Everyone who has weapons or ammunition should send them to Qusair and Homs to strengthen its resistance. Every bullet sent to Qusair and Homs will block the invasion that is trying to drag Syria back to the era of fear," Sabra said in a statement.
Assad's forces are intent on seizing Qusair in order to cement their hold on a belt of territory that connects the capital Damascus to Assad's stronghold on the Mediterranean coast, home to his minority Alawite sect, an offshoot of Shi'ite Islam that has largely supported him.
Seizing Qusair would also allow Assad to sever links between rebel-held areas in the north and south of Syria.
With Shi'ite Hezbollah prominent in the fight in Qusair, its involvement could drag Syria's civil war - which already pits mainly Sunni Muslim rebels, including radical Islamists and foreign fighters, against an Alawite-led army - into a more regional sectarian conflict.
Sabra warned that Hezbollah forces in Qusair could enflame Sunni-Shi'ite tensions across the Middle East.
"The invasion will light a sectarian fire that will destroy relationships between countries in the region and their people. No one will benefit other than Israel."
Pro-Assad media have reported major advances for Hezbollah and state forces. Rebels deny they have lost ground.
Some opposition sources privately said they believed that the army, lead by Hezbollah ground units, has seized about 60 percent of the town. But they say rebels are fighting back hard, as they consider it a battle that could determine the fate of the uprising.
EXPLOSIONS
"If we lose Qusair, we lose Homs, and if we lose Homs, we lose the heart of the country," said Ahmed, a rebel speaking by Skype from the nearby town of Homs as explosions and gunfire crackled in the background.
One rebel source, who asked not to be named, said Assad and Hezbollah forces had cut most of the opposition's overland supply lines into Qusair. But he said the rebels were still able to bring some supplies and fighters in through secret tunnels.
An analyst close to Qatari officials said the Sunni Gulf state, which has funneled money and weapons to the opposition, was looking for new routes to send in supplies to Qusair.
Rebel forces from other parts of Syria appear to have taken the call for support seriously.
The large Islamist Tawheed Brigade in the northern province of Aleppo published a video of a 30-car convoy it said was heading to Qusair.
Sedans and pickup trucks loaded with artillery and fighters sped down the highway, with rebels waving black Islamist banners shouting "God is Great."
As countries in the anti-Assad "Friends of Syria" alliance gathered for talks in Jordan, British Foreign Secretary William Hague said Iran and Hezbollah were "propping up" Assad.
"It is very clear that the Syrian regime is receiving a great deal of support, increasing support in recent months from outside Syria from Hezbollah and Iran. This is a regime that is increasingly dependent on external support," Hague said at a news conference in Amman.
Hague said Britain would urge international powers to set a date in the next few days for an international conference to try to end the Syrian conflict.
The talks are expected to be held in Geneva next month.
